Terms and conditions
These are the rules of the service. We wrote them to be understood on the first read, because nearly all of them come down to one idea: you answer for the photos you publish, we answer for the tool that publishes them.

01 What these terms are
These terms are the contract between Inversiones Globales en Tecnología, Intech Global, S.A. ("picspot", "we") and you for the use of picspot.cam and the app at https://app.picspot.cam. By creating an account or using a gallery you accept this document and the privacy policy.
If you are signing up on behalf of a company, you confirm you have authority to bind it, and "you" means that company.
02 Organisers and attendees
The organiser creates the gallery, uploads the photos and decides who can see them. The attendee opens the link and searches for themselves. Payment and permission obligations sit with the organiser; the attendee only has to use the gallery reasonably.
03 Your account
To publish galleries you need an account and you must be of legal age. The details you give us must be accurate and kept up to date.
You are responsible for your password and for whatever happens from your account, including the contributor links you hand to your crew. If you suspect unauthorised access, tell us as soon as you can.
04 Your photos stay yours
We acquire no ownership of anything you upload. You keep every right you have in your photos.
So we can run the service, you grant us a limited, non-exclusive, non-transferable licence solely to host, process, resize, analyse faces in, apply your frame to, and display or deliver those photos to whoever you authorise. The licence lasts as long as the publication does and ends when you delete the content.
We do not use your photos to promote ourselves unless you authorise it in writing, and we do not pass them to third parties beyond what running the service requires.
05 The permissions you must hold
This is the organiser's most important obligation. By publishing a gallery you warrant that:
- You hold the copyright in the photos, or authorisation from whoever does.
- You have the legal basis needed to publish images of the people in them and to have their biometric data processed for the purpose of grouping those images.
- You have told attendees that the event photos will be published in a gallery with face search.
- Where minors are involved, you hold permission from whoever has parental responsibility or guardianship.
- The content infringes no third-party rights and breaks no applicable law.
We provide the tool; the relationship with the people photographed is yours. If someone brings a claim against us over a gallery you published in breach of the above, you will bear the consequences.
06 Acceptable use
You may not use picspot to:
- Monitor, track or identify people outside the context of a specific event.
- Build biometric databases, cross-reference galleries with each other, or attempt to extract face vectors.
- Publish unlawful content, non-consensual sexual imagery, hateful material or anything that harasses someone.
- Impersonate another person or brand.
- Work around your plan's limits, resell the service without a prior agreement, or scrape the site automatically.
- Attack the security or availability of the service, or other users' access to it.
Face search exists so that someone can find themselves at an event they attended. Any use aimed at identifying other people falls outside what we allow.
07 Plans, packs and payments
There are two tiers. The Community plan is free and covers up to 2,500 photos a year; it is reserved for communities and non-profit events, requires an application and is approved at our discretion. The Pro plan is charged per photo, at $0.02 USD, from the first photo and without using the Community quota: a starter pack of 500 photos for $10 USD, then one-time packs from 1,000 to 50,000 photos, in steps of 1,000. Prices are shown in US dollars and exclude any applicable taxes.
- A pack is a one-time payment, not a subscription: it does not renew itself and it does not expire with time.
- Every image published in a gallery counts. Trashed or unpublished photos do not.
- Your audience's searches and downloads are never charged, however many attendees there are.
- If storage runs out before photos do, you can buy storage on its own at $0.023 USD per GB.
We may change prices going forward with reasonable notice. A change never affects a pack you already bought. If a payment fails, we may suspend publishing new photos until it is settled.
Packs are non-refundable once used, unless applicable law says otherwise or the service failed through our fault. If something looks wrong with a charge, write to us and we will look into it.
08 Storage and availability period
Each pack includes enough storage for that volume under normal conditions. On the Pro plan, published photos stay available for 12 months.
We will warn you before that period ends so you can download or renew. picspot is not a backup service: always keep your own originals.
09 Content removal
We may remove content or close access to a gallery if we receive a well-founded copyright or image-rights claim, if an authority orders it, or if the content breaches these terms.
Unless it is urgent or the law prevents us, we will tell the organiser and give them a chance to respond. To file a claim, write to [email protected] with the gallery link and the reason.
10 Service availability
We work to keep the service available and fast, but we do not guarantee a specific uptime figure unless we have signed one in a separate contract. There will be planned maintenance and, occasionally, incidents.
We may change or retire features. If a removal affects you significantly, we will give you reasonable notice.
11 Suspension and closure
You can close your account whenever you want. Doing so unpublishes your galleries and deletes their face vectors.
We may suspend or close an account that breaches these terms, puts other people at risk, or builds up unpaid invoices. Except for serious breaches, we will warn you first and give you time to download your content.
12 Warranties and liability
The service is provided as is. Face search is a statistical estimate: it may miss a photo you are in or suggest one you are not. We do not guarantee exact results.
To the extent applicable law allows, we are not liable for indirect damages, lost profits or lost data, and our total liability is limited to what you paid us in the twelve months before the event giving rise to it.
None of this limits liability that cannot lawfully be excluded, nor the rights consumer law gives you if you are acting as a consumer.
13 Changes to these terms
We may update these terms. We will change the date at the top and, if the change is significant, tell you by email or in the app before it takes effect. If you disagree, you can close your account.
14 Governing law and disputes
These terms are governed by the laws of [Jurisdicción pendiente], and any dispute will go to its courts, without prejudice to the forum consumers are entitled to by law.
Before going to court, write to us: almost everything gets solved with an email.
